1. Acceptance of Terms

By downloading, installing, or using the Kom tot Bloom mobile application (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms apply to all users of the App, including visitors, subscribers, and contributors of content.

 

2. Description of the App

Kom tot Bloom is a nutrition and food awareness application that enables users to:

• Scan product barcodes to retrieve ingredient and nutritional information

• View health indicators including NOVA processing level and Nutri-Score grades

• Access personalised nutritional recommendations (the "Natuur Score")

• Learn about food and nutrition through the Academy module

• Browse and save healthy recipes

• Track nutritional intake over time

• Consult a virtual nutrition assistant (Q&A module)

• Discover Bloom's preferred product alternatives

 

Important: The information provided by the App is for educational and informational purposes only and does not constitute medical, dietary, or clinical nutrition advice. Always consult a qualified healthcare professional before making significant changes to your diet, especially if you have a medical condition.

 

3. User Accounts

3.1 Registration

To access all features of the App, you must create an account. You agree to:

• Provide accurate, complete, and current information during registration

• Maintain the security of your password and account credentials

• Notify us immediately of any unauthorised use of your account at info@jannevents.nl

• Accept responsibility for all activities that occur under your account

 

3.2 Account Termination

You may delete your account at any time via Settings > Account > Delete Account. We reserve the right to suspend or terminate accounts that violate these Terms without prior notice.

 

4. Subscription and Payment

4.1 Free and Premium Tiers

The App offers both a free tier with limited features and a premium subscription ("Bloom Premium") with full access to all content and features.

 

4.2 Subscription Terms

• Subscriptions are billed on a monthly or annual basis as selected at checkout

• Payment is charged to your Apple App Store or Google Play account upon confirmation of purchase

• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period

• You may manage and cancel your subscription via your App Store or Google Play account settings

• No refunds are provided for partial subscription periods, except as required by applicable law

 

4.3 Price Changes

We reserve the right to modify subscription prices. We will provide at least 30 days' notice of any price change via email and in-app notification. Continued use of the App after the effective date of the price change constitutes acceptance of the new price.

 

4.4 Free Trial

Where a free trial is offered, it automatically converts to a paid subscription at the end of the trial period unless cancelled before expiry. You will not be charged during the trial period.

 

5. Acceptable Use

You agree not to use the App to:

• Violate any applicable law, regulation, or third-party right

• Transmit any harmful, offensive, or illegal content

• Attempt to gain unauthorised access to any part of the App or its infrastructure

• Reverse engineer, decompile, or disassemble any part of the App

• Scrape, crawl, or extract data from the App in an automated manner

• Impersonate any person or entity or misrepresent your affiliation

• Use the App for commercial purposes without our express written consent

• Interfere with the proper functioning of the App or its servers

 

6. Intellectual Property

All content within the App, including but not limited to text, graphics, logos, icons, images, Academy lesson content, recipes, nutritional scores, and software, is the property of Kom tot Bloom B.V. or its content providers and is protected by Dutch and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the App for personal, non-commercial purposes only.

Product data retrieved from Open Food Facts is subject to the Open Database Licence (ODbL). Ingredient information, NOVA groups, and Nutri-Score data originate from the Open Food Facts community database.

 

7. User-Generated Content

If you submit feedback, ratings, or other content within the App, you grant Kom tot Bloom B.V. a worldwide, royalty-free, perpetual licence to use, reproduce, and display such content for the purpose of operating and improving the App. You represent that you own or have the right to submit such content and that it does not infringe any third-party rights.

 

8. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, Kom tot Bloom B.V. disclaims all warranties, including:

• Fitness for a particular purpose

• Merchantability

• Non-infringement

• Accuracy, completeness, or reliability of nutritional data

• Uninterrupted or error-free operation

 

Nutritional and ingredient data is sourced from the Open Food Facts community database and may not always be accurate, complete, or up to date. Always verify ingredient information on the physical product packaging, especially if you have allergies or medical conditions.

 

9. Limitation of Liability

To the maximum extent permitted by applicable law, Kom tot Bloom B.V. shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages

• Loss of profits, revenue, data, or business opportunities

• Any harm arising from reliance on nutritional or health information provided by the App

• Temporary unavailability of the App due to maintenance or technical issues

• Any third-party content, products, or services accessible through the App

 

Our total liability to you for any claim arising under these Terms shall not exceed the total subscription fees paid by you in the 12 months preceding the claim.

 

10. App Updates and Availability

We reserve the right to modify, suspend, or discontinue the App (or any feature thereof) at any time, with or without notice. We will endeavour to notify users of significant changes. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App.

Updates to the App may be required to continue using certain features. We recommend enabling automatic updates to ensure access to the latest features and security patches.

 

11. Third-Party Links and Content

The App may contain links to third-party websites or services that are not owned or controlled by Kom tot Bloom B.V. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services. We encourage you to review the privacy policies of any third-party services you interact with.

 

12. Governing Law and Disputes

These Terms are governed by the laws of the Netherlands. Any dispute arising from or related to these Terms or your use of the App shall first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the competent courts in the Netherlands.

If you are a consumer, you also have the right to use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

 

13. Indemnification

You agree to indemnify and hold harmless Kom tot Bloom B.V., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party right.

 

14. Severability

If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

 

15. Changes to Terms

We reserve the right to update these Terms at any time. We will notify you of material changes via in-app notification and email at least 14 days before the changes take effect. Your continued use of the App after the effective date of the revised Terms constitutes your acceptance of the changes.
